These General Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by ONEMORE VENTURES LLC, trading as My Rocking Chair ("the Seller"), to consumers and non-professional buyers ("the Customers" or "the Customer"), wishing to purchase the products offered for sale by the Seller ("the Products") on the website myrockingchair.co.uk.
These Terms outline, in particular, the conditions regarding ordering, payment, delivery, and the management of any returns of the Products ordered by Customers.
These General Terms and Conditions of Sale may be supplemented by special conditions set out on the website prior to any transaction with the Customer.
These General Terms and Conditions of Sale apply to the exclusion of all other conditions, particularly those applicable to in-store sales or sales through other distribution and marketing channels.
They are accessible at any time on the website myrockingchair.co.uk and shall prevail, where applicable, over any other version or any other contradictory document.
As these General Terms and Conditions of Sale may be subject to subsequent modifications, the version applicable to the Customer's purchase is the one in force on the website at the date the order is placed.
The Products offered for sale on the website myrockingchair.co.uk are as follows:
The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity of the Products, are presented on the website myrockingchair.co.uk.
The Customer is required to read them before placing any order. The choice and purchase of a Product are the sole responsibility of the Customer.
Photographs and graphics presented on the website myrockingchair.co.uk are provided for illustration purposes. As wood is a natural material, slight variations in grain and shade may occur between items.
The Customer must refer to the description of each Product to know its properties, essential particularities, and delivery times.
Contractual information is presented in English and is subject to confirmation at the latest at the time of order validation by the Customer.
Product offers are valid within the limit of available stocks, as specified when the order is placed.
The contact details of the Seller are as follows:
In accordance with data protection regulations (UK GDPR and the Data Protection Act 2018), the Customer has, at any time, a right of access, rectification, objection, erasure, and portability of all their personal data by writing a letter or an email and proving their identity to the Seller's address mentioned above.
Validation of the order by the Customer implies acceptance without restriction or reservation of these General Terms and Conditions of Sale.
The Customer acknowledges having the capacity required to contract and purchase the Products offered on the website myrockingchair.co.uk.
It is up to the Customer to select the Products they wish to order on the website myrockingchair.co.uk, according to the following methods:
Any order placed, validated by the Customer, and confirmed by the Seller under the conditions and according to the methods described above on the website constitutes the formation of a distance contract concluded between the Customer and the Seller.
Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
The Customer will be able to track the progress of their order on the website myrockingchair.co.uk under the "Order Tracking" section.
The Seller does not intend to sell Products on the website to professionals, but exclusively to consumers or non-professionals for their personal needs. The Seller therefore reserves the right to refuse orders for the same Product in large quantities, specifically those containing more than 5 items.
Any changes to the order by the Customer can only be taken into account by the Seller within the limits of its capabilities and provided that they are notified by email to support@myrockingchair.co.uk at least 1 day before the scheduled date for shipping the order.
In the event that these modifications cannot be accepted by the Seller, any sums paid at the time the order was placed by the Customer will be returned to them within a maximum period of 14 days from the notification of the impossibility to accept the requested modifications (unless the Customer prefers to benefit from a credit note or an exchange).
Orders may be cancelled by the Customer outside the exercise of the right of withdrawal or cases of force majeure at least 1 day before the scheduled date for the supply of the ordered Products, at no cost to the Customer.
The Products are supplied at the current rates appearing on the website myrockingchair.co.uk when the order is registered by the Seller. Prices are expressed in Pounds Sterling (GBP), inclusive of VAT where applicable.
The rates take into account any reductions that may be granted by the Seller on the website.
These rates are firm and non-revisable during their period of validity, as indicated on the website, the Seller reserving the right, outside this validity period, to modify prices at any time. They include processing, shipping, transport, and delivery costs.
The payment requested from the Customer corresponds to the total amount of the purchase, including these costs.
The price is payable in full on the day the order is placed by the Customer, by means of secure payment, according to the following methods:
Payment by bank card is irrevocable, except in the case of fraudulent use of the card. In this case, the Customer may request the cancellation of the payment and the return of the corresponding sums.
The Products ordered by the Customer will be delivered within the United Kingdom.
The delivery time corresponds to the dispatch time indicated on the Product page plus the processing and transit time. Products are delivered within an average time of 2 to 5 business days to the address indicated by the Customer when ordering on the website.
Delivery is constituted by the transfer to the Customer of physical possession or control of the Product. Except in special cases or unavailability of one or more Products, the ordered Products will be delivered at one time.
The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the timeframes specified above. However, these periods are communicated for guidance purposes. If the ordered Products have not been delivered within 30 days after the indicative delivery date, for any cause other than force majeure or the Customer's fault, the sale may be cancelled at the written request of the Customer under statutory consumer protection conditions. The sums paid by the Customer will then be returned to them at the latest within fourteen days following the date of termination of the contract, to the exclusion of any compensation or deduction.
In the event of non-conformity of the delivered Product, the Seller undertakes to remedy it or reimburse the Customer, as indicated in the article "Seller's Liability - Guarantees".
The Seller bears the risks of transport and is required to reimburse the Customer in the event of damage caused during transit.
The transfer of ownership of the Seller's Products to the Customer will only be carried out after full payment of the price by the latter, regardless of the delivery date of said Products.
Regardless of the date of the transfer of ownership of the Products, the transfer of risks of loss and damage relating thereto will only be carried out at the moment when the Customer takes physical possession of the Products. The Products therefore travel at the risk of the Seller.
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal with the Seller, without having to justify reasons or pay any penalty, for the purpose of exchange or refund, provided that the Products are returned within fourteen days following the notification to the Seller of the Customer's decision to withdraw.
Returns must be made in their original and complete condition (packaging, accessories, instructions...) allowing them to be put back on the market in new condition, accompanied by the purchase invoice.
The right of withdrawal can be exercised online, using the withdrawal form available on the website myrockingchair.co.uk (see Schedule 2), in which case an acknowledgment of receipt on a durable medium will be immediately communicated to the Customer by the Seller, or by any other unambiguous statement expressing the willingness to withdraw.
If the right of withdrawal is exercised within the aforementioned timeframe, the Seller will refund the price of the purchased Product(s) together with the standard delivery costs initially paid by the Customer. Where the Customer chose a delivery method more expensive than the standard option offered by the Seller, the refund of delivery costs is limited to the cost of that standard option.
The direct cost of returning the Product is borne by the Customer. The Customer arranges and pays for the return carriage. The Customer remains responsible for the Product until it is received by the Seller, and is therefore advised to use a tracked and insured service and to retain proof of postage. Given the size and weight of the Products, the Customer is advised to obtain a quotation from their chosen carrier before exercising the right of withdrawal.
The Customer is informed of this before placing the order, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
The Customer may be liable for any diminished value of the Product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.
This paragraph does not apply where the Product is faulty, damaged on receipt, or does not correspond to the order. In those cases the return is arranged and paid for by the Seller, under the conditions set out in Article 11 - Seller's Liability - Guarantees.
The refund will be made within fourteen (14) days of the Seller receiving the returned Product, or of the Customer providing proof of having sent it back, whichever is earlier.
The Products sold on the website myrockingchair.co.uk comply with the regulations in force in the United Kingdom and have performances compatible with non-professional uses.
Independently of the right of withdrawal, the Products supplied by the Seller benefit automatically and without additional payment from the Customer's statutory rights under the Consumer Rights Act 2015. Products must be of satisfactory quality, fit for purpose and as described. If a Product is faulty or does not match its description:
The statutory rights apply independently of any commercial guarantee that may cover the Product.
The Seller will refund or replace Products or parts deemed non-compliant or defective. In such cases, return costs are borne by the Seller; where the Customer has paid them, they will be refunded upon presentation of receipts.
Refunds for Products deemed non-compliant or defective will be made as soon as possible and at the latest within 14 days following the finding by the Seller of the lack of conformity or defect. The refund will be made using the payment method used for the original purchase.
The Seller's liability cannot be engaged in the event of misuse, use for professional purposes, negligence, or lack of maintenance on the part of the Customer, as well as in the event of normal wear and tear of the Product, accident, or force majeure.
Nothing in these Terms excludes or limits the Seller's liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited by law, nor affects the Customer's statutory rights.
In application of data protection laws (UK GDPR / Data Protection Act 2018), it is reminded that the personal data requested from the Customer is necessary for processing their order and issuing invoices, among other things. This data may be communicated to any partners of the Seller responsible for the execution, processing, management, and payment of orders.
The processing of information communicated through the website myrockingchair.co.uk meets legal requirements regarding personal data protection, with the information system used ensuring optimal protection of this data.
The Customer has, in accordance with national and international regulations in force, a permanent right of access, modification, rectification, objection, portability, and restriction of processing regarding information concerning them. This right can be exercised under the conditions and according to the methods defined in the Privacy Policy on the website myrockingchair.co.uk.
The content of the website myrockingchair.co.uk is the property of the Seller and its partners and is protected by laws relating to intellectual property. Any total or partial reproduction of this content is strictly prohibited and is liable to constitute an infringement.
The Parties cannot be held responsible if the non-execution or delay in the execution of any of their obligations, as described herein, stems from a case of force majeure, meaning unpredictable, irresistible, and external events beyond the control of the parties.
These General Terms and Conditions of Sale and the operations resulting from them are governed by and construed in accordance with the law of England and Wales. They are drafted in the English language. In the event that they are translated into one or more other languages, only this official English text shall prevail in the event of a dispute.
This does not affect any mandatory consumer protection rights the Customer benefits from under the law of the country in which they live.
In the event of a complaint, the Customer is invited to contact the Seller first at support@myrockingchair.co.uk, so that an amicable solution can be found.
The Customer is informed that they may in any event resort to mediation or any other alternative dispute resolution (ADR) method in the event of a dispute, through an ADR provider approved in the United Kingdom.
Any dispute which could not be resolved amicably may be brought before the courts of England and Wales. If the Customer lives in Scotland or Northern Ireland, they may also bring proceedings in their local courts.
The fact that a natural (or legal) person orders on the website myrockingchair.co.uk implies full adherence and acceptance of these General Terms and Conditions of Sale and the obligation to pay for the Products ordered, which is expressly acknowledged by the Customer, who waives, in particular, the right to rely on any contradictory document, which would be unenforceable against the Seller.
Under the Consumer Rights Act 2015, the Seller is bound to supply goods that are of satisfactory quality, fit for purpose and as described, and is liable for any lack of conformity existing at the time of delivery. Goods conform to the contract if they match the description given by the Seller, are fit for the purpose for which goods of that description are commonly supplied, and match the quality of any sample or model shown. The Customer has a short-term right to reject faulty goods within 30 days of delivery, a right to repair or replacement, and, where these fail, a right to a price reduction or final right to reject. Claims may be brought up to 6 years from delivery (5 years in Scotland).
